[TRADEMARK] Precedent furor.

Post by Phoenix » Sun May 06, 2018 3:37 pm

For those who are unaware, there is a long thread on KBoards regarding a romance author TMing the word COCKY and the style she uses on her covers. It has rightfully gained her the backlash of the writing community in that the trademark of common words should not be allowed. If successful there will most likely be a rush to TM all the other common words used throughout the book world. Leaving us with barely nothing to place on our covers unless we pay someone for the privilege.

The author in question has raised the hackles of not only fellow authors, but her own readers whom she denigrates as not being intelligent enough to differentiate between imposters and herself. Her twitter lead is inundated with vitriole and ridicule for her smarmy attitude.

Apart from the fact that the author has issued C&D letters by herself and had books pulled from Amazon already, is the fact that she illegally got a TM on the font used in her signature series. It is an important issue which I urge you all to read. I do feel that she will not win, but only because some are standing up for themselves and others. It will be a bitter lesson for the author I feel, as her career may well hang in the balance. There has been a rash of one starring and bad reviews on Goodreads already, with many promising to do the same on the Zon.

Well worth reading.

And Romance Writers of America is taking up the cause against her. It seems like her trademark isn't going to stand.

Yes, I think the authors targeted by Ms. Hopkins have some pretty heavy hitters in their corner. She will not get away with it, and her reputation has been besmirched as a result of her cavalier(cocky?) attitude. Many romance readers have scrubbed her name from their TR lists. She is copping a shellacking on her twitter and FB sites by all comers. Indie authors are uniting and banding together against her.
