I need your advice! I just found out last night through a webinar that you have to have a privacy policy, terms of use, data security policy for your website. I don't have it! I can not afford FTC Guardian and can not afford a lawyer to do it for me. I have been stressing out all day because of this. Can I do this myself? It will take me a while to learn all of this! Can someone help me out with this? Thank you very much for your help! Have a great night!

What exactly is the question(s)?

Things like Terms of Use for a website can be picked up from other sites. Read the language, then rewrite it to fit your site.

I believe that is ONLY IF you keep people's names, addresses, etc. I have a website and I do not have a privacy policy, terms of use or anything else. I don't have any way of keeping people's names or addresses, I don't have an idea who looks at my website. Why would I need such things?

Don't believe everything you read/hear, especially on the internet.

While I have a contact me page that sends an email to my email address, I have no such things as you were told to have on either my author site or my business site.

My contact form (http://sleepingcatbooks.com/html-contact-form.php) has a Privacy Policy link at the bottom, if you'd like an example. It's extremely simple, and taken from other examples I found at the time. You'll see that it hasn't been updated since late 2012, but my use of information and cookies hasn't changed since then, so I don't see any reason to change my policy.

Usually there is language to the effect that: by entering this site you are agreeing to these terms of use . . . .

"Is it binding," is usually the $64,000 question (more for inflation). We all make agreements, ranging from "Sure, I'll take out the trash," to those 50 pages of 6 pt type you sign when you buy a house or a car (even buying a kitten from Pet Smart!), etc. What is binding ultimately is defined by whoever wins (again from our mothers, to our employers, the bank, etc.).

Some of us honor a handshake, others will contest those 50 pages. Most people won't take you to court, some people will always take you to court. Companies like Walmart and Costco will make exchanges or give refunds for products that have competitors tags on them . . . why, good will, and it is better to avoid a nasty fight.

Wow, first of all, Sarah, I want to say, I love your website. Easy to read and simple design. After reading the sample of your privacy policy, now it is clear to me on how to write one. Now I understand and I think I can do it.
